Acceptance of terms
Your access to the Flex platform (flex.com.ph) and any associated services constitutes acceptance of these Terms of Service, our Privacy Policy, and any service-specific terms. If you do not agree, you must discontinue use immediately.
What Flex provides
Flex (legally Flex Web Development Services) is a talent company based in the Philippines. Through this platform we provide:
- → Managed Staffing (Flex): we vet Filipino professionals and place them with client teams. On the managed model, Flex employs the people it places: contract, payroll, and ongoing support are ours.
- → Direct Hire (FlexDirect): we recruit and vet candidates whom the client then employs directly, for a one-time placement fee.
- → Flexperts: our build studio. We design and build complete web platforms end to end, and maintain a showroom of interactive prototypes demonstrating that work.
- → Talent Application & Assessment: an application system for Filipino professionals, including an online skills assessment and identity verification as part of vetting.
- → Articles & Insights: original editorial content covering technology, remote work, and hiring.
- → Contact & Inquiry System: secure channels for hiring briefs, project inquiries, support, and scheduled appointments.
Service agreements
These website terms govern your use of the platform. The services themselves run on their own contracts: every staffing engagement, whether managed or direct hire, and every Flexperts build is governed by a separate written agreement between Flex and the client, covering scope, fees, terms, and obligations. Submitting a brief through this platform is an inquiry, not a binding order, and no engagement exists until that agreement is signed. If these terms and a signed agreement ever conflict, the signed agreement prevails for that engagement.
For applicants
If you apply through our talent application, the following terms apply:
- → You must be at least 18 years old to apply. This is a hard requirement with no exceptions.
- → Everything in your application must be truthful and your own: your identity, your work history, your skills. Misrepresentation is grounds for immediate disqualification at any stage, including after placement.
- → The skills assessment must be completed by you personally. Having another person, or an automated tool, take or assist with the assessment on your behalf is a misrepresentation of your abilities and disqualifies the application.
- → Links we send you, such as assessment invitations, results, and appointment pages, are personal to you. Do not share or forward them.
- → Flex will never ask an applicant for payment at any stage of the process: not to apply, not to be assessed, not to be placed. Anyone requesting payment in Flex's name is not us. Report it to support@flex.com.ph.
Intellectual property
All content on the Flex platform is the intellectual property of Flex unless explicitly stated otherwise. This includes, but is not limited to:
- → Prototypes & Showroom: every prototype is an original creative work. All design elements, interaction patterns, layout compositions, animation sequences, and underlying code architecture are proprietary. Copying, reverse-engineering, or creating derivative works from any prototype is strictly prohibited.
- → Articles & Written Content: all articles, insights, and editorial content are original works published by Flex. Reproduction requires attribution and prior written consent.
- → Brand & Design System: Flex trademarks, logos, iconography, and unique interface components may not be used without written permission.
- → Source Code: the source code, build systems, and engineering methodologies powering the Flex platform are proprietary and protected under the Intellectual Property Code of the Philippines (R.A. 8293).
Acceptable use
When accessing the Flex platform, you agree to the following:
- → Do not scrape, crawl, or use automated tools to extract content, designs, or source code from the platform without written authorization.
- → Do not reverse-engineer, decompile, or attempt to reconstruct the design systems, interaction patterns, or code architecture of any prototype or page.
- → Do not use AI models, browser automation, or headless browsers to systematically download or replicate Flex content for training datasets or derivative works.
- → Do not transmit malicious code, attempt to probe or exploit vulnerabilities, or interfere with the platform's operation or security systems.
- → Do not submit false, misleading, or spam content through any form or communication channel, including talent applications and hiring briefs.
User submissions
When you submit information through the platform, whether a talent application, a hiring brief, a project inquiry, or a support request, you keep ownership of it. You grant Flex the right to use that information for the purposes it was submitted for: evaluating and placing applicants, responding to inquiries, and running the engagement that follows. How we handle that data is set out in our Privacy Policy. We do not use your submissions for marketing without your explicit consent.
Third-party services
The Flex platform integrates with third-party services to deliver its functionality:
- → Cloudflare: content delivery, edge computing, security, DNS, and file storage.
- → Google: email delivery, and calendar scheduling with Google Meet for appointments.
- → Anthropic: the AI conducting our skills assessment.
- → Didit: identity verification during applicant vetting.
- → hCaptcha: bot protection and human verification on public forms.
- → Meta (Facebook): Pixel tracking for conversion analytics on select pages.
Your use of these services is governed by their respective terms and privacy policies. Flex is not responsible for third-party service outages or policy changes.
Progressive Web App features
Flex operates as a Progressive Web App (PWA) and may utilize your browser's local storage, session storage, and Service Worker cache to improve performance and enable offline functionality. Installing the PWA is optional and does not grant Flex additional access to your device beyond standard web browser capabilities.
Service availability
We engineer for high availability and deploy on globally distributed infrastructure. However, we do not guarantee uninterrupted access. Maintenance, updates, and unforeseen circumstances may cause temporary disruption. We are not liable for any loss resulting from service downtime.
Disclaimers & limitation of liability
The Flex platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by Philippine law, Flex is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or reliance on any content published on it. The obligations of a signed service agreement are governed by that agreement, not by this section.
Governing law
These terms are governed by and construed in accordance with the laws of the Republic of the Philippines, including the Intellectual Property Code (R.A. 8293) and the Data Privacy Act of 2012 (R.A. 10173). Any disputes arising from these terms shall be resolved in the appropriate courts of the Philippines.
Changes to these terms
We may update these terms to reflect changes to our services, legal requirements, or operational practices. Material changes will be communicated through the platform. Continued use after changes are posted constitutes acceptance of the updated terms.
